Right, as stated in the 1st and 14th Amendments to the U.S. Constitution, to express information, ideas, and opinions free of government restrictions based on content. It may be restricted if it poses a "clear and present danger," a risk or threat to safety or other public interests that is serious and imminent (hence the prohibitions against falsely setting off a fire alarm or inciting others to violence). Restraints on speaking and publishing (freedom of the press), and upon action generally (incl. artistic expression), are fewer today than at any time in U.S. history. Many cases involving freedom of speech and of the press have also concerned defamation, obscenity, and prior restraint (see Pentagon Papers). See also censorship.
